But ever since the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Bayh%E2%80%93Dole_Act\" target=\"_blank\">Bayh-Dole<\/a> Act of 1980, universities and\/or their faculty can be granted unencumbered patents even if federal funding was used for research and development. <font color=\"#200020\">Naurex<\/font> was such a company that arose in the university; received grant and venture capital to develop <font color=\"#200020\">GLYX-13<\/font>; obtained the drug <a href=\"http:\/\/www.prnewswire.com\/news-releases\/naurex-announces-issuance-of-new-patent-for-novel-antidepressant-glyx-13-217569641.html\" target=\"_blank\">patent<\/a>; then <a href=\"http:\/\/www.allergan.com\/news\/news\/thomson-reuters\/allergan-successfully-completes-naurex-acquisition\" target=\"_blank\">sold itself<\/a> with the patent rights to <font color=\"#200020\">Allergan<\/font> for $560 M [well below the estimated cost of developing a new drug from scratch]. <font color=\"#200020\">Allergan&#8217;s<\/font> task is getting FDA Approval and marketing the drug at today&#8217;s inflated prices. In this increasingly common scenario, <font color=\"#200020\">Allergan<\/font> is more in the role of being a drug broker than scientific innovator or developer [or even much of a risk taker].
